Understanding Bankruptcy's Automatic Stay
Most of the time, when you file a lawsuit or other legal action, you do not get any relief until the end of the process, which could take weeks, months or years. Bankruptcy protection, however, offers an exception to that general rule.
The moment you file bankruptcy, you will get immediate relief from creditor harassment. Creditors must stop calling you and cannot take any collection actions against you.
This is called the automatic stay. It goes in place once your filing is submitted and stays in place until your bankruptcy case is over. At that point, any debts that are eligible for discharge will be gone permanently, so creditors will not be able to harass you about them.
Taking Immediate Steps to Stop Creditor Harassment
Even before your bankruptcy case is filed, you have a right under the Fair Debt Collection Practices Act to stop your creditors from calling you. We can help you put together a cease and desist letter that should stop the calls while we are working on your bankruptcy filing.
In addition, many of the statements made by debt collectors are untrue, and if so, you may have legal claims against the people who are lying to you.
