The bankruptcy process is overseen by a trustee appointed by the court. The good news is that, for most people, the process is much more informal than the idea of filing for protection from a court would suggest.

Will You Have to Go Before a Judge in a Courtroom?

The short answer to this question is no. The only required proceeding in a Chapter 7 bankruptcy case is called a 341 hearing. This is a meeting that occurs in an informal office setting, around a table. There is no judge; the bankruptcy trustee is in charge.

If you hire us to represent you, we will attend the 341 hearing with you, representing your interests throughout the process.

The bankruptcy trustee will probably ask you some questions, and if you are confused about how to answer any of them, we can advise you.

If our firm has done our job right — and we will — your paperwork will explain everything the trustee needs to know, and the hearing will be just a formality. Most hearings last for five minutes or less.

Will You Have to Confront Your Creditors?

At some point, you will probably hear the 341 hearing referred to as a meeting of creditors. That is because your creditors will receive a notice of the hearing, and they have a right to attend. In the overwhelming majority of cases, however, they do not show up.

Generally there is no point to your creditors trying to fight it. Usually, they only come to the hearing if they suspect fraud. If your creditors do show up, we will assist you as needed.
