General Information

The name, address, date of birth, social security number for you, and your spouse if filing a Joint Petition.

Aliases

Any other name used by any party named in the Petition.

List of Property

List all of your personal property, real estate, and any other assets, interests, contingent assets, un‐liquidated asset or any other legal interest that has value. We will provide you with a template to use as a guide.

List of Debts

List of all your debts with the Creditor's name, address (including zip code), account number, phone number (if you have it), contact person (if you have one), Co‐Debtors (if any), Assignees/ debt collectors/ attorneys who are attempting to collect any given debt. We will provide you with a template to use as a guide.

NOTE: If you have access to the internet then we can provide an online questionnaire in which you may list almost all the information we will need. It is easy to use and will help you become very organized.

List of Dependants

Full name and address.

Income

We will need copies of your six most recent pay stubs along with proof of any other income you earned over the six months immediately preceding the filing of the Petition. We will also need to know your yearly income for the three tax years prior to the year in which you are filing this Petition along with copies of your tax returns. If you do not have copies then we may be able to obtain a copy of your tax transcript from the IRS and use them instead.

Miscellaneous Financial Affairs

  • Have any payments been made to any Creditors in the 90 days immediately preceding the filing of the Petition? If so, whom and in what amounts?
  • Have any payments been made to any family members or business associates in the 365 days immediately preceding the filing of the Petition? If so, to whom and in what amounts?
  • Are you involved in any lawsuits?
  • Has any of your property been repossessed or seized?
  • Have you closed any bank accounts recently? If so, what is the name of the bank and the ending balance?
  • Do you have a safe deposit box? If so, what are the contents?
  • Have you been divorced in the past? If so, what is the date of the Decree of Dissolution, the Case #, the County in which it was filed and the name of your prior spouse?
  • Have you made any gifts recently? If so, then to whom and what was the value of the gift?
  • Do you own a business?

Taxes

You must have filed your taxes for the three tax years immediately preceding the year in which you are filing the bankruptcy Petition in order to obtain a discharge. If you have not done that then you should get that process started right away. A bankruptcy Petition can be filed prior to filing your taxes but any tax refund due to you may be in jeopardy and seized by the Trustee if it is due to you after you have filed your bankruptcy Petition. Proper planning can avoid this outcome.
