The Chapter 7 Process

In a Chapter 7, the trustee takes over the assets in a debtor's estate and liquidates them to pay creditors. However, most Chapter 7 bankruptcies are "no asset" cases, meaning the debtor's property is exempt from being seized.

Important steps in the Chapter 7 bankruptcy process include:

  • Taking the means test to determine if you qualify for Chapter 7
  • Filing the bankruptcy petition, which enacts the automatic stay, stopping creditors from taking legal action against you
  • Attending a meeting with the bankruptcy trustee, typically 30 - 45 days after filing
  • Debt discharge: usually within six months of filing

The Chapter 13 Process

In a Chapter 13, debt is not immediately discharged. Rather, you create a payment plan and propose it to the bankruptcy court. The plan will last three or five years, depending on your specific circumstances.

Over that period of time, you will make payments to the bankruptcy trustee, who will in turn pay your creditors. Chapter 13 also stops creditors from foreclosing on your property, garnishing your wages and taking other legal actions against you.
