The Chapter 7 Process in Arizona

Typical Chapter 7 Bankruptcy From Start to Finish

If Chapter 7 bankruptcy is right for you based on the results of the means test and on your specific needs, the Arizona Law Group of Trezza & Associates will guide you through every step of the process. We will educate you about the process at the beginning of the case, so there will be no surprises. Here is a brief overview of the steps involved:

Step 1: Hire our law firm. Contact us today to schedule a consultation with experienced bankruptcy lawyer Stephen Trezza. We will help you complete as much of the bankruptcy paperwork as possible in our office and send you home with a questionnaire to fill in the blanks.

Step 2: Bring your completed questionnaire back to us along with copies of some documents that we will need.

Step 3: We will prepare your paperwork for submission to the Bankruptcy Court.

Step 4: We will file your paperwork with the bankruptcy court. An automatic stay will immediately take effect. The court will notify your creditors to cease debt collection.

Step 5: The bankruptcy trustee will send you a letter requesting photocopies of recent bank statements, pay stubs, tax returns, titles and other documents. Respond immediately. The more organized and complete your response is, the better.

Step 6: Attend a debtor education class. We will provide you with information about this.

Step 7: Attend the 341 hearing. One of our attorneys will be at your side.

Step 8: The trustee will issue a document called the Report of No Distribution or request a claims bar date.

Step 9: If there are no objections, a discharge will be issued, and your obligation to pay unsecured debts is relieved. Creditors rarely object. When they do, we can handle it.

Step 10: The bankruptcy court will issue an order closing your case. You will have the fresh start that you have been waiting for.
